NOTICE TO ALL MEMBERS
February 1, 2001

Pursuant to Article X, Section 1, of the Declaration of Covenants and Restrictions for Granada Villas, Orange County, Florida and Notice of Provisions for Granada Villas Homeowners' Association, Inc. the Board of Directors will begin to actively enforce the attached Rules and Regulations for Granada Villas thirty (30) days from the date of this Notice.

Please review all of the restrictions for Granada Villas which are found in the Declaration as well as the Rules and Regulations for Granada Villas, and take all action(s) necessary to ensure that your property is in compliance with same.

ARTICLE X
GENERAL PROVISIONS

Section 1. Enforcement. The Association, or any other Owner, shall have the right to enforce, by any proceeding at law or in equity, all restrictions, conditions, covenants, reservations, liens and charges not or hereafter imposed by the provisions of this Declaration. Failure by any of the aforesaid to enforce any covenant or restriction herein contained shall in no event be deemed a waiver of the right to do so thereafter.

GRANADA VILLAS RULES AND REGULATIONS

The following Rules and Regulations are summaries of restrictions found in the Declaration of Covenants and Restrictions for Granada Villas "Declaration" and are intended to maintain the quality of our community. All property owners are to be aware of these rules and are responsible for notifying occupants of their property about these Rules and Regulations. The homeowner as well as the occupant will be held responsible for any violations incurred by an occupant or guest. All questions or clarifications should be addressed to the management company.

1. ARCHITECTURAL REQUIREMENTS: The Architectural Review Committee will hereafter be referred to as the ARC. No landscaping, building, fence, wall or other structure shall be commenced, erected, installed, removed or modified upon any lot or dwelling unit without prior ARC approval. A written application requesting approval shall be delivered to the ARC, according to requirements of Article VII of the Declaration, together with all pertinent plans, specifications, drawings and other data. Approval/Disapproval by the ARC will be judged as to harmony of design and location based upon the original Granada Villas designs. The results will be returned to the homeowner in written form. Any rejections may be forwarded to the Board of Directors, Granada Villas Homeowners Association, hereinafter referred to GVHOA, for review and final determination.

2. EXTERIOR MAINTENANCE OF HOMES: All homeowners must maintain the exterior appearance of their dwellings and walls to conform to the harmony and appearance originally designed and built as Granada Villas. Article VIII, Section 18, of the Declaration of Covenants and Restrictions titled Exterior Maintenance, provides that maintenance of dwelling units or lots is the responsibility of the homeowner. Any dwelling units or lots damaged or unsightly as a result of a homeowner's failure to maintain the property as determined by the Board of Directors must be repaired within 30 days of receipt of notice from the Board of Directors. The Declaration provides that if, after 30 days notice to repair, the repair has not been completed, the Association shall have the right to make reasonable repairs and are entitled to levy a special assessment and lien against the responsible homeowner(s) for the costs incurred.

Paint must be maintained and kept to the original colors. Painting must have prior approval of the ARC. The colors are: GRANADA BUFF with BUTTERNUT BROWN trim or NAVAJO WHITE with CHOCOLATE BROWN trim. Color Wheel maintains the color specifications for The Granada Villas. All outside air conditioning equipment must be maintained in an enclosure replicating the original enclosure provided by the builder, keeping within the harmony and design of Granada Villas. The enclosure shall be maintained and painted to the trim color assigned to each dwelling. Owners of homes located along the perimeter walls are responsible for painting the interior surface of the perimeter walls. ARC approval is required before painting or replacement.

The owner(s) of a residence(s) adjoining a party wall (defined as common between homeowners) and/or a common driveway must maintain all party walls and common driveways. Either adjoining owner shall have an equal right to use of a party wall and a common driveway for access to each lot or dwelling served thereby. This right is subject, however, to payment by the owner seeking to tie into the party wall of any costs involved in tying into the party wall and payment of any damage(s) occasioned therefrom. If a party wall or common driveway should be damaged by an owner, resident, tenant, or guest of the owner, whether negligent, intentional, unintentional, or otherwise, the owner committing the damage is responsible for the repair of any damages to the property and to any adjoining property as well as for any injuries caused to any person(s) as a result of such damage, or to the GVHOA for any expenses incurred by the Association as a result of such damage, as applicable.

3. IRRIGATION: No owner shall modify, change or perform any activity, including maintenance, to the irrigation system provided by the Association. Any and all maintenance to the irrigation system shall be performed and directed by the Board of Directors and designated maintenance personnel. Any damage to the irrigation system, other than ordinary wear and tear, shall be the responsibility of the owner of that property and the Association has the right to impose a special assessment against that owner for such extraordinary costs. Repair costs incurred during the construction of ARC approved modifications to the lot or dwelling unit (walls, pools, patios, screen enclosures, additions, landscaping, etc.) shall be the sole responsibility of the owner. Should you have a problem with the irrigation system or need repair, please call the Irrigation Hotline. The telephone number for the Hotline is listed in the Granada Newsletter. Your call will be logged and a Work Order will be written. For emergencies call the number listed in the Newsletter.

4. GARAGE DOORS: Garage doors should remain closed to maintain your safety and the aesthetics of the community. Garage doors must conform to the original design and the ARC must approve replacement or repair.

5. MAILBOXES: Mailboxes must conform to U.S. Postal regulations and must have the approval of the ARC before replacement. Mailboxes must be kept in good repair, and must display the house number at the top of the mounting post and replicate the original design.

6. SIGNS: No commercial signs, including "For Sale", "For Rent" or other similar signs shall be erected, placed, or maintained on any lot EXCEPT with the written permission of the Board of Directors. If such permission is granted, the Board of Directors shall have the right to restrict size, color, and content of such signs. For safety, all dwelling units should display the assigned street number in a prominent location and are subject to ARC approval as detailed in Article VII and VIII of the Declaration.

7. LOT USE/VEHICLE PARKING: No lot or dwelling unit shall be used for any purpose except residential. No objects such as trailers, house trailers, sheds, mobile homes, campers, boats, boat trailers or other similar objects shall be stored or parked on any lot or right of way overnight or for a continuous period of time in excess of four (4) consecutive hours. This storage/parking restriction applies to all part(s) of the common area. All vehicles must be parked on driveways or in garages. See Article VIII, Sections 3 through 5, of the Declaration for details. Street parking is allowed for a maximum of 4 hours. Do not block driveways or right-of-ways. Parking is not permitted on non-paved areas. Parking on grass damages the turf and the irrigation system (i.e., sprinkler heads). Commercial vehicles, boats and trailers must be garaged if on the property more than 4 hours. Please inform your guests of the parking rules. It is advised that all residents have a Granada Villas sticker on their car. Parking stickers are required for use of the recreation area and are available from the management company and at town hall meetings.

8. LANDSCAPE AND LAWN SERVICE: Lawn service at Granada Villas consists of mowing, edging, blowing, fertilizing, weed/insect control, and irrigation. The Association will not maintain any enclosed area of your yard. Any problems or questions about services should be directed to the Management Company. Lawn ornaments are not allowed as they interfere with irrigation and lawn maintenance. Lawn care does not include weeding of planter boxes or landscaped areas. Homeowners are responsible for insuring that planter boxes and landscaped areas are kept clear of weeds and are not allowed to become overgrown. Do not plant in common areas. Any homeowner who has an enclosed yard that abuts the perimeter wall is responsible for maintaining the landscaping so that it does not encroach or extend over the perimeter wall to the GVHOA common area side. It is the homeowners' responsibility to keep hoses or other gardening tools off the lawn when not in use. Any planned landscaping changes, etc. must have prior approval of the ARC.

9. GARBAGE/TRASH/RECYCLE BINS: Household garbage/trash is picked up on Tuesday and Friday mornings. Containers may be placed out after 6:00 p.m. on the day prior to the scheduled pickup but no later than 6:00 a.m. on the day of pickup Due to the wildlife in the area, it is advisable to use a tightly sealed trash container or garbage can for your garbage/trash and residents are responsible for promptly cleaning up all trash that is scattered during pickup. Recycle bins are picked up on Friday morning. If you were not provided with recycle bins, please contact the Orange County Solid Waste Hotline at 407-836-6601. All "pickup" items are to be placed at the end of your driveway, within 3 feet of the curb. Putting "pickup" items on the grass interferes with lawn care and irrigation sprinkler heads. If the pickup day falls on the same day as the lawns are to be mowed, please make sure your containers are placed at least 6 inches from the edge of the lawn. If you are planning to be out of town, please make arrangements with a neighbor to put your container(s) out and then away for you. Garbage/Trash Containers and Recycle Bins should be stored in your garage or at the back of your house when not in use. Garbage/Trash/Recycle Bins should be picked up and put away as soon as possible after pickup

10. YARD WASTE: Tree branches, leaves, etc. are picked up on Wednesday. Branches are to be no longer than 3 feet, and must be tied in bundles weighing no more than 60 lbs. For further information, please call the Resource Recovery Hotline at 407-836-6601, from 8:00 a.m. to 5:00 p.m., Monday through Friday. Bundles may be put out after 6:00 p.m. the evening before scheduled pickup but not before 6:00 a.m. the morning of pickup All "pickup items are to be placed at the end of your driveway, within 3 feet of the curb. Putting "pickup" items on the grass interferes with lawn care and irrigation sprinkler heads. If the "pickup" day falls on the same day as the lawns are to be mowed, please make sure your "pickup" items are placed at least 6 inches from the edge of the lawn.

11. RECREATION AREA: This area is for Granada Villas residents and their guests only. Keys for the recreation area gate and tennis court are available from the management company for a nominal charge. Do not give or loan your key to nonresidents. Guests must have an adult escort. Insurance regulations require that the gate for the tennis court and boat ramp remain closed at all times and residents are responsible for keeping the gate closed. Please use the garbage cans provided and keep the area clean. Pet rules apply to this area also. All vehicles temporarily parked inside the recreation area must have stickers on the vehicle. Guest parking is allowed providing the sponsoring resident is present and the vehicle displays identification of the sponsoring owner's name and address viewable through the windshield. Storage/parking of any vehicles or other articles in excess of 4 hours will result in, as a minimum, the loss of recreational and common area privileges for 60 days and will be enforced.

12. RECREATIONAL EQUIPMENT: Recreational structures used on your property, such as basketball hoops, children's play equipment, including swings or swing sets, sliding boards, sandboxes, etc. are subject to ARC approval as detailed in Article VII and VIII of the Declaration and must not be visible when not in use and must be in the back yard at all times.

13. NEIGHBORHOOD WATCH PROGRAM: Granada Villas is a Neighborhood Watch Community. Please get to know your neighbors and the people and cars normally around your home. If you see any unusual cars, unfamiliar people or suspicious activity, please call the Orange County Sheriff's Department and report it right away. Please use 911 only in case of Emergency. A well-lighted community is a safer community. Residents are encouraged to turn on their exterior yard, porch or garage lights during nighttime hours.

14. DISTURBING NOISE: Excessive and unnecessary noise or vibration is that which interferes with the quality of life and can interfere with health, safety and general welfare of the public. Chapter 15, Article 5, Section 15-180 of the Codes for Orange County defines noise as any sound produced in such quantity and for such duration that it would annoy, disturb or may injure a reasonable man or woman of normal sensitivities. It is prohibited for any person or entity to produce any "noise" within any private or public property, including right of way that can be heard beyond the property lines or right of way. "Noise" emitted by lawn, garden, power tools or other such equipment is prohibited in residential areas between the hours of 10 p.m. and 7 a.m. Please do not call the Board of Directors to report such violations. Enforcement will be by the Orange County Sheriff or the Environmental protection officer of Orange County, Florida.

15. ANIMALS (PETS): GVHOA adopts Orange County Code Part II, Chapter 5, Animals, Article II, Animal services in its entirety. In order to comply with the above code and the desires of the GVHOA governing Board, please keep your Dog leashed, remove excrete and do not allow the animals either through activities or noise, to become a nuisance. Cats must display identification on a collar, and a current rabies license.

16. MANAGEMENT COMPANY: By and under the direction of the Board of Directors, a Property Management Company is contracted to provide the day-to-day business activities of our Association Corporation. An Agent, called our Property Manager, provides through the company staff the management of maintenance and administrative tasks. These tasks include the accounting of our monies such as collections and debt payments, the administration of contracts, property closing activities, and the day-to-day contact with homeowners and contractors. The Agent also attends our monthly meetings. All inquiries and other homeowner transactions with the Granada Villas Homeowners Association shall be directed to the Management Company and the designated Agent.
